I think smoking should be treated like drinking.
People have the right to drink, but no one expects them to be able to do so wherever they want. No one expects every public place to provide a bar, etc. And secondhand smoke should be treated the same as drunken vomit: an involuntary by-product of drug addiction, inflicted on innocent bystanders. Doesn't mean anyone should expect they have a right to puke on others...
Smokers should have strictly limited places where they can indulge, places where what they do impinges on no one else - and criminal charges for those who don't follow those regulations. Same as drinkers.
