My mood won't change to despairing until such time as the Supreme Court fails to strike it down for being blatantly unconstitutional.

If Bush has to deal with a hostile Congress for the rest of his term, my mood will actually change to chipper.

Is the Supreme Court able to strike it down on their own, or does it require an appeal from someone who is adversely affected by it?

It requires a case. However, this law is so off-the-scale controversial I would be very surprised if no such case emerged; and between the judicial and legislative checks to the executive, Schoolhouse Rock might turn out to be right after all.

This makes me so mad. I hate living in a country where I fear that I could be disappeared because someone in the government calls me a terrorist. No attourney. No contact with the outside world. No habeas corpus. Nothing. I want to have confidence that, if I am unjustly accused of a crime, I will have a chance to fairly defend myself. The more I hear about the "war on terror", the less I feel that way.
